EU Commission Rejects Extension of Performers’ Rights Term for Audiovisual Works — Term Remains 50 Years

The European Commission, in its latest report on the application of the Term Extension Directive, concluded that there is no need to amend the current duration of rights for performers and producers of audiovisual (AV) works, meaning that there are no plans to extend the term from 50 to 70 years.

 

Under Directive 2011/77/EU, the 50-year term remains applicable to AV performers, while the 70-year extension applies only to musical recordings (phonograms). The Commission emphasized that it will continue to monitor market developments, particularly regarding the implementation of the new provisions of the DSM Directive, which could influence a future review of this decision.

 

Serbian law also treats audio and AV performers differently — the rights of performers fixed on a phonogram last for 70 years from the date of its release, while the rights of AV performers last for 50 years from the date the work was published.
